Ranchi/Jharkhand: A POCSO court in Ranchi granted bail to Abhishek Kumar Sinha, a teacher at Shraddhanand Seva Ashram Middle School, in a case involving alleged obscene behavior with minor girl students. This is the same case that was first brought to light by 'The Mooknayak'. In its order, the court noted that no other girl student had filed any complaint against the accused teacher, nor had the school administration received any complaint. The accused was released on a personal bond of ₹20,000 with two sureties.

Serious allegations were leveled against teacher Abhishek Kumar Sinha, who was appointed to the school in December 2023. He was accused of trapping minor schoolgirls in a love trap, making obscene conversations with them, appearing nude on video calls, and even taking one student to a hotel. One victim was so traumatized that she stopped coming to school for several days.

An anonymous complainant had submitted a written complaint to the Education Secretary and the Jharkhand Women's Commission. The complaint claimed that at least 10-15 girl students had fallen victim to the teacher's actions, and that despite the school management being fully aware, no action was taken.

The accused teacher, during obscene chats with a minor student, asked her about her private parts, the color of her undergarments, demanded that she wear a deep-neck top on video calls, and asked her to lift her top. Most shockingly, he directly asked the student: "Will you let me loose your virginity?"

On August 19, 2025, 'The Mooknayak' published the matter as a priority. The report revealed that despite school principal Anuj Kumar Singh being informed on August 18, no police report was filed. Instead, the school tried to suppress the matter by merely issuing a warning letter to the teacher.

The impact of 'The Mooknayak' report was immediate. Ranchi DC Manjunath Bhajantri took cognizance and ordered an inquiry by the DEO and DSE. Jharkhand Chief Minister Hemant Soren also sought a factual report on the matter. The Child Welfare Committee (CWC) also lodged a complaint at Sukhdeonagar police station.

Arrest and Bail Proceedings

An FIR was registered against him at Sukhdeonagar police station (Case No. 451/2025) under Section 12 of the POCSO Act and Section 75 of the Juvenile Justice Act. Following a police investigation, the accused teacher Abhishek Kumar Sinha was arrested on May 17. He was produced in court on May 18, and sent to judicial custody.

The hearing took place in the court of AJC-IV-cum-Special POCSO Judge Birendra Kumar Srivastava. Initially, the court had rejected the accused's bail plea and sent him to jail. Later, hearing a new bail petition filed under Section 483 of BNSS-23, the court granted bail.

Accused's advocate Vikrant Sinha argued for bail. He pleaded that the accused had been in judicial custody since May 18. The FIR was registered by the CWC based solely on a local newspaper report, without naming any victim. The accused had a good professional relationship with a colleague named Nidhi, but after his marriage was fixed, he distanced himself from her. Angered by this, Nidhi, along with her husband Shiv Tiwari, allegedly framed him in a false case. The accused fully cooperated with the investigation, handing over his mobile phone and laptop, but no obscene chats were recovered. No student or school administration had made any oral or written complaint against the accused.

The SPP (Special Public Prosecutor) opposed bail, calling the act heinous as the accused is a teacher who sexually harassed minor students. One victim student had recorded her statement under Section 183 of BNSS, supporting the prosecution's case. The investigation was still ongoing.

What the Court Found After Reviewing the Case Diary

Paragraphs 12 & 13 : The school administration had received no complaint of sexual harassment against the teacher.

Paragraph 14 of the Case Diary: The Investigating Officer (IO) questioned students visiting the school campus; none complained about the teacher's behavior.

Regarding the sole victim's statement: While one student had alleged sexual harassment, the accused submitted documents in which the same student admitted that no sexual harassment had occurred and that some WhatsApp chats were made by her using another person's number.

Considering all the facts, the court observed:

"The updated perusal of the case diary also reveals that no other girl student has leveled any allegation against the applicant and even the school authorities have not received any complaint regarding sexual harassment of the students by the accused."

Based on these observations, on May 30, the court granted bail to accused Abhishek Kumar Sinha. He has been directed to attend the court proceedings physically on each and every date of hearing unless exempted from appearance, when trial commenced. He has been further directed not to interfere in the investigation of the case and appear before the investigating officer of the case as and when called and required and also to produce any document or electronic device which is required for the purpose of the investigation by the investigating officer and further not to leave the District of Ranchi without informing the IO of the case till the filing of the charge-sheet.

Although the accused teacher has been granted bail, a victim girl, speaking to 'The Mooknayak' earlier, had said: "I won't tell anyone anything, I don't want anything, whatever happened has happened." Fear of social stigma and family reputation continues to silence her.
