Constitutional Crisis Looms: Supreme Court 'Mute' Controversy and TMC's Call for CEC Impeachment Spark Nationwide Outrage

New Delhi— A severe controversy has erupted over the independence of India's judiciary and the Election Commission, following allegations of preferential treatment given to Medha Roopam, Noida District Magistrate and daughter of Chief Election Commissioner (CEC) Gyanesh Kumar. The crisis deepened after Trinamool Congress (TMC) MP Mahua Moitra openly labeled the CEC a "criminal" acting as a "rogue agent," demanding his immediate impeachment and warning of a nationwide democratic uprising.

The judicial storm centers on an open letter dated September 24, 2026, addressed to the Chief Justice of India by the Lawyers Association for Constitution (LAFC), as seen in the file HS_l3IWbUAA7atJ.jpg. The association raised grave concerns over the out-of-turn listing of special leave petitions filed by Medha Roopam.

The petitions challenge strictures passed against her for detaining a student under the National Security Act during a workers' protest. The LAFC highlighted that assigning this case to a specific bench, bypassing the prevailing roster, constitutes special preferential treatment that undermines public confidence in the judicial process.

Furthermore, the LAFC strongly protested the muting of the video conferencing facility during the hearing of this crucial matter. Investigative journalist Saurav Das corroborated these concerns, revealing that Justice Satish Chandra Sharma's bench inexplicably muted the audio before staying the Allahabad High Court's penalty against Roopam.

Das pointed out a glaring conflict of interest, alleging that Justice Sharma's son currently holds four highly lucrative government counsel panels. Das also noted that on the exact same day, Justice Sharma delivered a split verdict that effectively delayed a constitutional challenge regarding the appointment process of Election Commissioners.

Amplifying the crisis, TMC MP Mahua Moitra delivered a blistering attack on CEC Gyanesh Kumar in an interview with IANS. Moitra revealed that an impeachment motion against Kumar is already pending in the Rajya Sabha with over 70 signatures.

She accused Kumar of single-handedly assassinating the country's democratic process with the ruling party's assistance. Moitra argued that Kumar is not protected by Section 16 of the CEC and EC Act, 2023, because he acted as a rogue agent rather than discharging official duties, citing 14 instances of dissent by the other two Election Commissioners over the past 10 months alone.

Moitra detailed specific allegations of electoral manipulation, including the illegal centralization of software to bypass grassroots officers and the unauthorized modification of Form 6, which allegedly disenfranchised millions of legitimate voters.

She highlighted that 33 lakh voters in Bengal were arbitrarily removed from the electoral rolls. Demanding an immediate halt to the Summary Revision (SIR) process and a re-election based on the January 2025 rolls in affected states, Moitra issued a stark ultimatum. She warned that if these systemic violations are not rectified, millions of disenfranchised citizens will take to the streets, leaving the government with nowhere to hide.
