Dodging Justice? Minor Victim Takes Asaram to SC Over 'Health' Bail

Survivor Exposes Bail Violations

Jodhpur- In a significant development in the high-profile case involving self-styled godman Asaram Bapu, convicted for the rape of a minor, the survivor has approached the Supreme Court to contest the six-month interim bail granted to him by the Rajasthan and Gujarat High Courts. The victim has urged the apex court to revoke the bail immediately, citing potential risks to the ongoing legal proceedings and her personal security if Asaram remains at large.

On Monday, the Gujarat High Court lifted the stipulation requiring three police personnel to accompany Asaram at all times. However, the court dismissed his separate request for permission to deliver religious sermons or interact with groups of devotees. Meanwhile, a hearing was slated in the Jodhpur High Court on Asaram's application seeking a stay on his life imprisonment sentence and an extension of his temporary relief.

The matter, linked to an existing petition, was reassigned to another bench after Justice Farzand Ali recused himself, citing his prior professional ties to Asaram's legal team during his time as an advocate.

In her Supreme Court petition, the survivor has strongly contested the bail decisions from both high courts, which were primarily based on Asaram's health concerns. Her counsel argued that Asaram wields considerable influence, raising fears that he could attempt to intimidate or influence witnesses if released.

The plea emphasizes the gravity of the offense, a heinous crime warranting lifelong incarceration and asserts that prolonged freedom on mere medical grounds undermines justice. The victim has also expressed multiple apprehensions about the dangers posed by his release.

The survivor's lawyer further alleged that Asaram has been flouting the conditions of his interim bail, which was explicitly granted for medical treatment, by embarking on unauthorized trips across cities. Following his release, he initially stayed at his Jodhpur ashram for a few days before moving to Barmer. Reports now indicate he has reached Ahmedabad. Such movements, the petition claims, directly contravene the court's directives and highlight the need for swift intervention to prevent further misuse of the relief.
