New Delhi- In a significant victory for the Pradhan Mantri Bhartiya Janaushadhi Pariyojana (PMBJP), the New Delhi District Court has issued a permanent injunction against a Bhopal-based firm, "Jan Aushadhi Sangh," for using a deceptively similar name. The court found that the company was intentionally infringing on PMBJP's registered trademark "Jan Aushadhi" to create confusion among consumers and capitalize on the goodwill of the established brand.

The court order mandates that the violator, along with its proprietors and partners, cease any use of the "Jan Aushadhi" mark. This ruling aims to protect the integrity of PMBI's brand and ensure that consumers continue to receive genuine products at affordable prices through Jan Aushadhi Kendras.

Furthermore, the court has directed the violator to surrender all infringing materials bearing the "Jan Aushadhi" trademark to PMBI for destruction. Additionally, damages of Rs. 10 lakhs have been awarded in favor of PMBI.

PMBJP, launched by the Department of Pharmaceuticals, Ministry of Chemicals & Fertilizers, Government of India, aims to provide affordable generic medicines to all. Through its network of 13,800 Jan Aushadhi Kendras across the country, the program offers medicines at significantly lower prices, enabling savings of 50% to 90% for consumers. This initiative has established Jan Aushadhi as the largest retail pharmacy chain in India.
