Kerala High Court dismisses case against teacher accused of beating student

Kochi- The Kerala High Court, while dismissing a case against a school teacher for allegedly beating a student, highlighted the growing pressure on teachers who fear criminal prosecution for disciplinary actions.

The court's observation came during the hearing of a teacher's petition against charges filed under Section 75 (cruelty to child) of the Juvenile Justice Act and Section 324 (voluntary causing hurt by dangerous weapons or means) of the Indian Penal Code. The teacher was accused of beating a student who had allegedly placed his leg on the desk.

The court expressed concern that teachers are now working under duress, fearing criminal cases and potential imprisonment for their actions. The court pointed out that the teacher was accused of beating the student with a stick after he called her an abusive word, and that the student himself admitted to this in his statement.

The bench drew a parallel to the historical tale of Drona and Ekalavya, highlighting the stark contrast between the traditional respect for teachers and the current "upside down" relationship. The court emphasized that the teacher did not act with malicious intent and quashed the case against her.
